Terms of Use

1) Who we are

Foster Wealth Ventures LLC (“FWV”, “we”, “us”) provides education-first digital tools such as FWV Calculators, GoldMIND AI, The Herbal Code 411, and Bible Bedtime Stories. Our Services include public areas and, where applicable, private membership or PMA-style offerings.

2) Acceptance of Terms

These Terms form a binding agreement between you and FWV. Supplemental terms may apply to certain features and will be presented when relevant. If you continue using the Services after changes take effect, you accept the updated Terms.

3) Eligibility & Accounts

• Must be able to form a binding contract in your jurisdiction.
• You are responsible for your account credentials and all activity under your account.
• Provide accurate information and promptly update it as needed.

4) Plans, Billing, and PMA Areas

• FWV Calculators: Free and paid tiers as described on /pricing.
• Other products: GoldMIND AI, The Herbal Code 411, and Bible Bedtime Stories may have separate access rules or pricing, including private membership (e.g., PMA-style) contexts.
• Billing: Subscriptions renew automatically until canceled. Taxes may apply. You can cancel at any time; benefits continue through the current billing period.
• No refunds unless required by law or stated otherwise in the specific offer.

5) Acceptable Use

• No illegal, infringing, harassing, deceptive, or harmful activity.
• No scraping, reverse engineering, or circumvention of access controls.
• No use of the Services to create competing datasets, models, or products in violation of these Terms.

6) Intellectual Property

The Services are owned by FWV or its licensors and protected by law. You receive a limited, revocable, non-transferable license to access and use the Services for your personal or internal business purposes, subject to these Terms.

7) Your Content

You retain rights to content you submit. You grant FWV a non-exclusive license to host, process, display, and use your content solely to provide and improve the Services. Do not submit content you lack rights to share.

8) Third-Party Links & Providers

We may link to third-party sites or use third-party providers (e.g., analytics, payments). FWV is not responsible for third-party content, policies, or actions.

9) Education-Only Boundaries

• No financial advice: Market content and calculators are educational only.
• No medical advice: Wellness content is educational only; consult a clinician.
• No legal advice: Informational only; consult a licensed attorney.

10) Markets, Risk & Performance

• Markets are volatile and unpredictable; losses can exceed principal.
• Backtests, simulations, or AI-generated insights are hypothetical and may not reflect real outcomes.
• You are solely responsible for your decisions and risk management.

11) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FWV DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FWV AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.

13) Indemnification

You agree to defend, indemnify, and hold harmless FWV from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

14) Termination

We may suspend or terminate access if you violate these Terms or for security or operational reasons. Your obligations under these Terms that by their nature should survive will survive termination.

15) Governing Law

These Terms are governed by the laws of the state where FWV is organized, without regard to conflict of laws rules. Venue and jurisdiction will be in appropriate courts in that state.

16) Changes to Terms

We may update these Terms. Material changes will be posted in the Services. Continued use means you accept the changes.
